In the latest Contract To Buy And Sell Real Estate Contract by the Colorado Real Estate Commission, effective January 1, 2016, there are now in excess of 25 conditions in which the buyer may terminate a valid contract with the seller. Probably, the most innocuous one in the mind of the seller can be found in Section 10.5 “Property Insurance Objection Deadline”. Simply stated, if for any reason the buyer decides that the annual insurance premium or the terms of the policy for the property is unsatisfactory in any way “in Buyer’s sole objective discretion”, buyer has the right to terminate the contract WITHOUT seller’s approval. The previous Earnest Money received is totally refundable to buyer. So…you think you have “sold” your property? Only when the Closing Funds are credited to your account.
